This Privacy Policy (“Policy”) applies to liquidityservices.com and all other websites, applications or mobile applications (each a “Website” and collectively the “Websites”), owned and operated by Liquidity Services, Inc. and its various subsidiaries (collectively, “Liquidity Services”, “us,” “we,” and “our”), including but not limited to:

Our  Policy  states what information we collect, how that information is collected, for what purposes we collect information (including specifically the legal basis on which Personal Information we collect from you will be processed), how that information is used, who we share it with and under what circumstances that information would be released.  Our Policy will also explain what rights you have in relation to your Personal Information, what steps we take to secure your private information and what steps you should take to safeguard that information. Unless otherwise noted, the disclosures that describe how and why we collect and use your Personal Information also describe how and why we collected and used your Personal Information within the past twelve (12) months.

Types of Personal Information We Collect and How We Collect It
We collect the following categories of Personal Information about you. Note that the Personal Information we collect about you may vary depending on the nature of your interactions with us and may not include all of the examples listed below.

Identifiers, such as your name, alias, postal address (including, city, state, postal code, and country), unique personal identifier, online identifier, email address, telephone phone number, secondary number, account name, IP address, social security number, driver’s license number, passport number, and other similar identifiers you provide to us.
  2. Personal Records (including Personal Information described in Cal. Civ. Code § 1798.80(e)), such as name, signature, social security number, address, telephone number, passport number, driver’s license or state identification card number, employment, bank account number, credit card number, debit card number, or other financial information.
  3. Characteristics of protected classifications under local or federal law, including age and date of birth, gender.
  4. Commercial information, including records of personal property, products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies.
  5.  Internet or other electronic network activity information, such as your Internet or other similar activity, usage statistics, information about your device (including browser and operating system), your browsing history, search history, information on a consumer’s interaction with a website, application logs, device data and registration, social media account information or advertisement, access times, and referring site.
  6. Geolocation data.
  7. Audio, electronic, visual, thermal, olfactory or similar information.
  8. Professional or employment information, such as your job title, company name (including company website url and number of employees).
  9. Inferences drawn from any of the information we collect to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  10. Sensitive Personal Information, including Personal Information that reveals a consumer’s Social Security, driver’s license, state identification card, or passport number; Personal Information that reveals a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; Personal Information that reveals a consumer’s precise geolocation.

We may request additional information from you depending on certain transactions, contractual or regulatory requirements. We will notify you of what information we need, and how it will be used.

We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the California Consumer Privacy Act (“CCPA”).

Sources of Personal Information
We collect information about you and how you interact with us in several ways, including:

  1. Information you provide to us directly. We collect the information you provide to us directly, such as when you register for an account with us through any of our Websites or submit information to us (such as in connection with a bid or purchase, when you submit an inquiry, etc.).
  2. Information automatically collected or inferred from your interaction with us. We automatically collect technical information about your interactions with us (such as IP address and browsing history).
  3. Information from public sources.
  4.  Information from third parties. We receive information about you and your interactions with us from third parties, such as from your employer or co-workers, third party service and content providers, credit reporting agencies, companies that provide or sell lists of potential purchasers, and others interacting with us.
  5. Information collected through interactive Website features. We may receive personal information from our vendors that provide certain interactive features on our Websites. Your use of these interactive features is voluntary, and we may retain the personal information that you submit through the features. For example, we may offer an interactive chat feature on our Websites to answer questions and for other customer service purposes. When you participate in the interactive chat, either with a virtual or live agent, the contents of the chat may be captured and kept as a transcript. By using these features, you understand that our vendors may process the information obtained through the feature to provide the service on our behalf.

How We Use Your Personal Information?

  4. In a de-identified, anonymized or aggregated format. When converted to a de-identified, anonymized, or aggregated format, data no longer constitutes Personal Information and we may use this information for any purpose.  We may use and share anonymized or aggregated information with third parties.
  5. For marketing. We may use your Personal Information to send you e-mail alerts and newsletters regarding upcoming auctions, sales events and information about our products and services which we anticipate may be of interest to you. We will obtain your prior consent before sending you e-mail alerts and newsletters where required for compliance with applicable data protection laws.
  6. For any other purposes for which you provide consent.

With Whom Do We Share Your Information?
We may share your Personal Information with the categories of recipients described below:

  1. Liquidity Services Affiliates: We may share your Personal Information within the Liquidity Services group of business entities.
  2. Service Providers: We may share your Personal Information with external service providers, such as Salesforce, Oracle Eloqua, Amazon Web Services and Microsoft Azure, whose services we may utilize from time to time to assist us in our provision of services to you and to assist us in carrying out our business activities.
  3. With Third Parties to Provide You with Services or Communications: We may also provide other Website users, vendors, third party partners, subcontractors, or service providers with information as required in order to provide services you request or to complete a transaction.
  4. Business Partners, other Website users or other Third Parties: We may also provide your Personal Information to our business partners, website users, or third parties for their own purposes, including for third party marketing. If legally required, we will seek your consent before engaging in such sharing.
  5. Law Enforcement, Legal Institutions, and Government Entities: In case of a subpoena, court order or official request, we may share your Personal Information with or at the request of law enforcement, legal institutions, or government entities to investigate, prevent or take action regarding suspected illegal activities, fraud or potential threats, or exercise legal rights or defend against claims, when we believe that doing so may protect your safety or the safety of us or others, or as otherwise permitted or required by law.
  6. Third Parties as Part of a Sale or Merger: As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or merges with us your Personal Information will be disclosed to such entity. Also, where we carry out an asset sale of a particular business division, your Personal Information (if held by such business division) may be considered an asset of ours and as such it is possible it will be sold or transferred to the purchasing third party.
  7. Auditors: We may provide transaction-related information to government or private auditors to inspect or validate our business practices, accounting records, or financial reports. Any release of information for such a purpose will be done under standard confidentiality restrictions.

We disclose and the above categories of Personal Information to our service providers and contractors for the following business or commercial purposes.

  • Ensuring security and integrity of Personal Information
  • Debugging to identify and repair errors that impair existing intended functionality
  • Short-term, transient use, including, but not limited to, nonpersonalized advertising
  • Performing services on our behalf
  • Providing advertising and marketing services (except for cross-context behavioral advertising)
  • Undertaking internal research for technological development and demonstration
  • Undertaking activities to verify or maintain the quality or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us
  • Processing, maintaining, or collecting Personal Information on our behalf
  • Detecting or protecting against malicious, deceptive, fraudulent or illegal activity

We disclose Personal Information to vendors that facilitate cross-context behavioral advertising, targeted advertising, and other advertising and marketing, including through Cookies, as defined in the “Do We Use Cookies?” section below. Under California and Texas privacy law, a “sale” of Personal Information does not necessarily involve an exchange of money. Instead, the term also includes disclosures of Personal Information to third parties that may use the information for their own purposes, such as Cookie providers. In this context, during the last 12 months, we have sold and/or shared for cross-context behavioral advertising and targeted advertising the following categories of Personal Information:

The categories of recipients to whom we may have sold and shared Personal Information include our vendors and other third parties for cross-context behavioral advertising and targeted advertising, as well as other marketing and advertising services that we utilize on our Websites. We only “sell” Personal Information to third parties as defined under California and Texas privacy law for the purposes of Cookies or other tracking technologies. We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age.

Where you provide Personal Information to us for the purposes of an enquiry, the basis for processing is that it is required as a legitimate interest of ours as a business to respond to your enquiry, or in such jurisdictions where legitimate interest is not a permissible lawful basis for processing, your consent.

Where we enter into a business relationship with you, we rely on the legal basis of performance of a contract with you for processing your Personal Information on the basis of that contractual relationship and to complete a transaction with you.

Where we process your Personal Information for the purposes of sending you marketing communications (such as buy alert emails, information on upcoming sales events, special announcements, etc.), we will rely upon the legal basis of legitimate interests and/or consent (if required and obtained) for processing your Personal Information for those purposes. Where we use your Personal Information to enhance or develop features, products and services we rely on the legal basis of legitimate interest as it is necessary for our legitimate interest to provide a responsive service to our customers to keep them satisfied, or in such jurisdictions where legitimate interest is not a permissible lawful basis for processing, your consent.

Where we process your Personal Information to comply with our legal and regulatory obligations we rely on the legal basis that such processing is required in order to fulfill a legal obligation.

Before we alter the reason for using any Personal Information you have provided to us, we will notify you of our intended change in use of that information, ensuring such use complies with applicable data protection law and where necessary obtain your consent prior to using your Personal Information in a new way. Notwithstanding the foregoing, in Canada the basis of processing Personal Information is consent.

Do We Transfer Your Personal Information Outside Your Country?
Your Personal Information shall generally be stored and processed in the US. Your personal data may be stored and processed in any country where we or our affiliates or approved partners have facilities or operations, including but not limited to the UK, Hong Kong and China. Information processed in another country may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.

From time to time there may be transfers between members of our group of business entities into and/or out of the European Economic Area (EEA).

For all cross-border transfers of Personal Information we ensure appropriate security measures and legal safeguards are in place.

How Long Do We Retain Your Personal Information?
We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected;

A. UK and EEA Rights.
You have a number of rights when it comes to your Personal Information. What Steps Do We Take to Secure Your Personal Information?
We are committed to keeping your Personal Information safe and secure.

We use appropriate technical and organizational measures to protect against the loss, misuse and alteration of Personal Information.

Do We Use Cookies?
